This work is essentially an attempt to refute the theory of legal positivism, and at the same time to advance the author's own somewhat unique formulation of natural law theory. Though Juha-Pekka Rentto makes a comprehensive and almost eclectic use of authors as diverse as, for example, Thomas Aquinas and Lawrence Kohlberg, he seems determined to approach legal philosophy from the natural law tradition, while adding a few notable exceptions of his own. In his opinion, natural law theories which (...) attempt to build a system on some one first principle ignore the practical importance of natural law. In fact, he will go on to say later that "rule-like principles are otiose in that they either are against the appropriate reasons for action, or they add nothing to them". This work is essentially a history of the scholastic conception of dialectica from Garlandus Compotista to William Ockham, with an eye to rendering intelligible the puzzling nature of late medieval treatises on logical obligations. Such treatises seem to countenance violations of fundamental and indisputable logical rules, for example, that a disjunction is false if both of its disjuncts are false. In large part to explain this apparent surd development in medieval logic, Eleonore Stump has collected into a single volume twelve (...) separately published essays. Some philosophers have offered structural representations as an alternative to indicator-based representations. Motivating these philosophers is the belief that an indication-based analysis of representation exhibits two fatal inadequacies from which structural representations are spared: such an analysis cannot account for the causal role of representational content and cannot explain how representational content can be made determinate. In fact, we argue, indicator and structural representations are on a par with respect to these two problems. This should not be surprising, we contend, (...) given that the distinction between indicator and structural representations is better conceived as one involving degree rather than kind. (shrink)

For two principal reasons, this is a welcome translation of Thomas Aquinas's treatment of faith. First, it is one of the very few English translations of Aquinas that has heeded Aquinas's own sage advice on translating--preserve the sense of the original but adapt its style to suit the language into which it is being translated. Most anglophone translators make Aquinas appear as if he concocted a highly technical language to impress his brother Dominicans. Jordan, on the other hand, rightly understands (...) that while Aquinas uses words and phrases in very precise ways, he never does so at the expense of their common, ordinary meanings. In fact, Aquinas's precise language is unintelligible without its being seen as rooted in ordinary language and naturally developed through the philosophical and theological traditions he inherited. Thus, by avoiding the obscure Latinate English that plagues other translations and, instead, rendering Thomas into felicitous English with due attention to the sources, Jordan's translation well reflects the accessibility of the original. Westminster, Md.: Christian Classics, 1989. Pp. lviii + 651. $78.00 (cloth). There are probably just a few of us familiar with Dominico Gravina's Compendium rythmicum, an ancient little book that summarizes the entire Summa theologiae in the same Latin meter as " Tantum ergo." But doubtless many are familiar with the experience Gravina must (...) have had that led him to write such a book. It is the same experience that has led to a remarkable number of synopses, compendia, introductory translations, selections, and most recently to Timothy McDermott's Concise Translation. These attempt to present the doctrine of the Summa without the massive weight of syllogism and definition, unfamiliar style, and innumerable (sometimes obscure) references, which make it so daunting a task for the unprepared reader. For example, Paul Glenn in Tour of the Summa excises every objection and response and summarizes only the bodies of the articles. Walter Farrell in Companion to the Summa does not attempt trans· lation hut instead rewords and restructures the Summa in the typically modern paragraph style. However, these works have their shortcomings. By neglecting the doctrine contained in the responses and by failing to provide any transition from the summary of one article to another, the Tour considerably weakens the ordo disciplinae which, as Thomas argues in his prologue, is essential to this work. In this regard, even Anton Pegis's Introduction to St. Thomas Aquinas tends to stumble along, despite being a close translation. The Companion, on the other hand, does preserve a continuity of thought, but in the final account it is Thomas's thought only secondhand. The Concise Translation, however, masterfully combines the strengths of these hooks, while avoiding their weaknesses. For it achieves concision in a manner that respects the order and development of the Summa, " not by selecting out parts, hut by compressing and distilling the whole" (p. xiii). Yet at the same time it is a translation. It is essentially Thomas in a similar form, approximately one sixth the size. McDermott admits that he has made certain omissions (for example, some of the remarkably lengthy discussions of the ceremonial and judicial precepts of the Old Law), but in these cases he retains enough to give the reader a sense of Thomas's treatment. There are of course 7~7 728 BOOK REVIEWS many passages which would he impossible to make more concise (for example, the proofs for God's existence), except by adapting them to a modern format. Here McDermott's use of modern punctuation and sentence structure tends to smooth out the stacatto (though extremely precise) structure of Thomas's syntax. At a glance, the Concise Translation appears as a thoroughly modern text, with paragraphs, titled sections, chapters, bibliography, and indices. Not surprisingly, it is divided into three main parts: God, Journeying to God, and The Road to God. Each of these is divided into chapters (numbered continuously through the parts) that correspond more or less to the so-called Treatises. For example, Part One, Chapter Five, entitled "Man's Place in Creation," corresponds exactly to the Treatise on Man. These chapters, in turn, are divided into sections which correspond closely to the major divisions that Thomas outlines in his introductions at the heads of various questions. The ohjec· tion/response format, however has completely disappeared, and the only evidence of the question/article format appears at the heads of certain paragraphs and in the margins. But this does not mean that the ohj ections and responses have altogether vanished. McDermott's careful eye has picked out many of the important distinctions they con· tain and has skillfully incorporated them into complete and unified paragraphs. This holds true also with many instances of the sed contra. Finally, in streamlining his text, he has done away with most references, keeping just enough to indicate on whom Thomas primarily relied. This regrettably leaves the reader unaware of Thomas's extensive use of his predecessors. But all in all, McDermott's format makes the text eminently readable. The concept of population is central to ecology, yet it has received little attention from philosophers of ecology. Furthermore, the work that has been done often recycles ideas that have been developed for evolutionary biology. We argue that ecological populations and evolutionary populations, though intimately related, are distinct, and that the distinction matters to practicing ecologists. We offer a definition of ecological population in terms of demographic independence, where changes in abundance are a function of birth and death processes alone. (...) However, demographic independence is insufficient on its own so we supplement it with the idea of shared habitat. An ecological population is a group of organisms of the same species in a habitat that manifests DI. Given the importance of metapopulation dynamics to modern ecology, an account of ecological population must apply to this domain as well. Thus, we extend our definition of ecological population to the metapopulation. To facilitate the extension, we introduce the metahabitat—a collection of spatially segregated habitat patches shared by a single DI population. This enables us to diagnose some unhelpful trends in the metapopulation literature and emphasize the importance of habitat dynamics in pursuit of the goals of theoretical ecology and conservation biology. Pancreatitis is a complex, progressively destructive inflammatory disorder. Alcohol was long thought to be the primary causative agent, but genetic contributions have been of interest since the discovery that rare PRSS1, CFTR and SPINK1 variants were associated with pancreatitis risk. We now report two associations at genome-wide significance identified and replicated at PRSS1-PRSS2 and X-linked CLDN2 through a two-stage genome-wide study. The PRSS1 variant likely affects disease susceptibility by altering expression of the primary trypsinogen gene. The CLDN2 risk allele is (...) associated with atypical localization of claudin-2 in pancreatic acinar cells. The homozygous CLDN2 genotype confers the greatest risk, and its alleles interact with alcohol consumption to amplify risk. DBS Think Tank IX was held on August 25–27, 2021 in Orlando FL with US based participants largely in person and overseas participants joining by video conferencing technology. The DBS Think Tank was founded in 2012 and provides an open platform where clinicians, engineers and researchers can freely discuss current and emerging deep brain stimulation technologies as well as the logistical and ethical issues facing the field. The consensus among the DBS Think Tank IX speakers was that DBS expanded in (...) its scope and has been applied to multiple brain disorders in an effort to modulate neural circuitry. After collectively sharing our experiences, it was estimated that globally more than 230,000 DBS devices have been implanted for neurological and neuropsychiatric disorders. As such, this year’s meeting was focused on advances in the following areas: neuromodulation in Europe, Asia and Australia; cutting-edge technologies, neuroethics, interventional psychiatry, adaptive DBS, neuromodulation for pain, network neuromodulation for epilepsy and neuromodulation for traumatic brain injury. Gregory T. Doolan provides here the first detailed consideration of the divine ideas as causal principles. He examines Thomas Aquinas's philosophical doctrine of the divine ideas and convincingly argues that it is an essential element of his metaphysics. According to Thomas, the ideas in the mind of God are not only principles of his knowledge, but they are productive principles as well. In this role, God's ideas act as exemplars for things that he creates. As Doolan shows, this theory (...) of exemplarism is an integral part of Thomas's account of the existence and order of the created universe. It also accounts in part for the freedom of God's creative act. The volume begins with an introduction to Thomas's doctrine of exemplarism and then addresses his arguments for the existence of exemplar ideas within the mind of God. Having established the existence of divine ideas, Doolan considers how Thomas reconciles their multiplicity with God's simplicity. The work identifies the various things for which Thomas posits divine ideas. As Doolan is careful to show, Thomas does not consider all of these ideas to be exemplars because not all of them act as causal principles. After identifying the ideas that do act in this way, Doolan considers how such exemplars can be causes of natural things without compromising the causality of natural agents. The volume culminates with a consideration of the role that the divine ideas play within the structure of Thomas's theory of participation. ABOUT THE AUTHOR: Gregory T. Pp. 181. $34.95, hardcover.Once again we are indebted to the University of South Carolina Press for a fine contribution from its Studies in Rhetoric/Communication series. Gregory Clark sets parallel aims: to apply Kenneth Burke's (...) critical vocabulary to cultural history, and to read American tourist sites and literature in the frame of Burke's notion of "identity" (147). Clark sees the American public landscape as "constituting in individual citizens a shared sense of common identity as members of a national public" (148). He claims that such shared experiences are as rhetorical as are more typical instances of public discourse. Thus American tourism has contributed to developing us into a national community.Clark supports his theme of rhetorical influence with six case studies: New York City, Shaker villages, Yellowstone National Park, the Grand Canyon, the Lincoln Highway, and the 1915 San Francisco Panama Exposition. While Burke's vocabulary offers a handy point of departure, the real news is in [End Page 172] Clark's discussion of the meaning and prominence of each of his six exemplars as cultural icons.This may be most evident (and endearing) as Clark recalls his own boyhood visits to Yellowstone, where he stood in the parking lot and was as captivated by the variety of license plates from across the country as by the hot springs and mudpots (69). This too was a celebration of nationhood. Equally fascinating is his consideration of the efforts of Stephan Mather, Mary Colter, and the Fred Harvey Company both to preserve national parklands and to develop a befitting "National Park Service Rustic" architectural style to enhance the natural landscape (this long before Disney's theme parks). Such typical excerpts almost cry out for Ken Burns or the History Channel to recreate the optimistic climate of a Romantic Post-Bellum civic culture depicted by Clark.The book becomes more tedious when its repeated invocation of Burkian terms tilts toward veneration. In his lifetime, Burke was unnerved by uncritical academic worship. He sought understanding, not deification. As he remarked, "They are an evangelical brood, bejeez. So... I [became] an observer at my own funeral."1 His wariness of academic enthusiasm is well taken. It does no disservice to Burke, for example, to recognize that his "identification" is a reworking of Vico's "ingenium" outfitted in creaky 1920s literary machinery.2 Shorn of some of the cumbersome Burkian baggage, the book's exemplars emerge as epideictic celebrations of the American tourist phenomenon and its part in shaping a national Romantic consciousness:And as rhetoric they traffic not in actions but in attitudes. People can encounter them without ever thinking of themselves as anything but spectators. Even in that role they are being educated... in matters of individual and collective identity.(148)Seen thus as reminders of our forebears' vision in pioneering the development of a national landscape trust, Clark's work edifies and opens us to the quiet excitement of meditative discovery. Since the late 1960s, philosophy for children has become a global, multi-disciplinary movement involving innovations in curriculum, pedagogy, educational theory, and teacher education; in moral, social and political philosophy; and in discourse and literary theory. And it has generated the new academic field of philosophy of childhood. Gareth B. Matthews (1929-2011) traced contemporary disrespect for children to Aristotle, for whom the child is essentially a pre-intellectual and pre-moral precursor to the fully realized human adult. Matthews Matthews dubbed this the “deficit (...) conception of childhood” and wrote extensive critiques of its perpetuation in Jean Piaget’s stage model of cognitive development and in Lawrence Kholberg’s stage model of moral development. He published the first book (1994) in the field of philosophy of childhood and wrote a column of reviews of philosophically-oriented children’s books. He argued that even academic philosophers can benefit from the freshness and directness of children’s thinking. For Matthew Lipman (1923-2010) and Ann Margaret Sharp (1942-2010), the child is only potentially a philosophical agent and grows into becoming such by means of a philosophical education. Lipman invented the literary genre of children’s philosophical fiction, which systematically reconstructs key philosophical issues and positions in language accessible by children, attempts to help children recognize philosophical dimensions of their own experience, and models philosophical dialogue. Lipman and Sharp developed a protocol for a “community of philosophical inquiry,” in which people with diverse experiences, ideas and concerns dialogue together around a shared philosophical question, with the aim of forming reasonable, meaningful judgments about the matter. The early success of philosophy for children was due in part to its coincidence with the critical thinking movement in education, in which Lipman was an important figure. Its emphasis on ethics has justified its use as a program of ethics, character, and even religious education. It has also been used for civics education, because of how it instantiates democratic deliberation and power-sharing. At the same time, philosophy for children has been criticized by religious and social conservatives, developmental psychologists, and philosophers. Today, the diversity of approaches, aims, materials, and grounding theories of philosophy for children signifies different understandings of philosophy, childhood and education, which have become “essentially contested concepts” within the movement. Philosophy for children is no longer unified by an identifiable theory, purpose, pedagogy, method or curriculum, but is now used to further a number of disparate educational agendas. Shaun Gallagher’s (1992) heuristic of four schools of hermeneutics is helpful in understanding these competing agendas. Conservative hermeneutics is the attempt to devise methods of interpretation that uncover and preserve truth or original meaning without distortion or bias. This is consonant with the use of philosophy for children to help young people appropriate the fundamental questions, ideas and skills of (Western) philosophy as a resource for understanding the world and managing their own experience, and with the understanding critical thinking as a way of avoiding prejudice and approaching truth. Critical hermeneutics approaches interpretation—including teaching and learning—as a method of liberating the interpreter from the racist, sexist, homophobic, capitalist, religiously fanatical, and other kinds of ideologies that commonly distort thinking, feeling and behavior. This is consonant with those who argue that the attributes of mutual criticism, inclusion, solidarity, self-regulation, and distributed power make the community of philosophical inquiry an ideal site for recognizing and overcoming ideology. Others find philosophy for children politically ineffectual due to the limited role of students and teachers in co-constructing the curriculum and its lack of an explicit component of political critique and action. Radical hermeneutics suggests that because every text is open to a plurality of meanings, the purpose of interpretation is not to artificially constrain that plurality but to play with the signs that constitute the text in order to achieve fresh insights. A radical hermeneutical strand is identifiable in the philosophy for children literature when scholars resist the idea that the aim of philosophical dialogue is to find consensus or to narrow down on the most reasonable conclusions. Moderate hermeneutics holds that the work of interpretation is the attempt to reach meaning or shared understanding in a process modeled on dialogue between the familiar and the strange. This is consonant with those who argue that philosophical traditions can still give meaning to (young) people’s lives, but that those traditions must be continually reinterpreted (including by children) in order to survive and flourish. Fifty-odd years since its inception, philosophy for children has deepened and diversified, both theoretically and as a field of practice. Perhaps the only point of agreement among (most) everyone in the movement is that children’s philosophical thinking, variously understood, is necessary for the realization of the intellectual, moral, and political agency the movement attributes to them. Statistical mechanics is one of the crucial fundamental theories of physics, and in his new book Lawrence Sklar, one of the pre-eminent philosophers of physics, offers a comprehensive, non-technical introduction to that theory and to attempts to understand its foundational elements. Among the topics treated in detail are: probability and statistical explanation, the basic issues in both equilibrium and non-equilibrium statistical mechanics, the role of cosmology, the reduction of thermodynamics to statistical mechanics, and the alleged foundation of the very (...) notion of time asymmetry in the entropic asymmetry of systems in time. The book emphasises the interaction of scientific and philosophical modes of reasoning, and in this way will interest all philosophers of science as well as those in physics and chemistry concerned with philosophical questions. The book could also be read by an informed general reader interested in the foundations of modern science. (shrink)

A range of views on the morality of synthetic biology and its place in public policy and political discourse.

This paper presents statistical default logic, an expansion of classical (i.e., Reiter) default logic that allows us to model common inference patterns found in standard inferential statistics, including hypothesis testing and the estimation of a populations mean, variance and proportions. The logic replaces classical defaults with ordered pairs consisting of a Reiter default in the first coordinate and a real number within the unit interval in the second coordinate. This real number represents an upper-bound limit on the probability of accepting (...) the consequent of an applied default and that consequent being false. A method for constructing extensions is then defined that preserves this upper bound on the probability of error under a (skeptical) non-monotonic consequence relation. (shrink)

The use of contingent valuation methods for estimating the economic value of environmental improvements and damages has increased significantly. However, doubts exist regarding the validity of the usual willingness to pay CV methods. In this article, we examine the CV approach in light of recent findings from behavioral decision research regarding the constructive nature of human preferences. We argue that a principal source of problems with conventional CV methods is that they impose unrealistic cognitive demands upon respondents. We propose a (...) new CV approach, based on the value-structuring capabilities of multiattribute utility theory and decision analysis, and discuss its advantages and disadvantages. (shrink)

Fernand Dumont (1927-1997) was a sociologist, philosopher, theologian, and poet. A prominent intellectual in Quebec, he is recognized for his research on the sociology of knowledge and the foundations of modern culture. Dumont's work conceives of culture in terms of both memory and distance, arguing that without culture, man would be immersed in the monotony of his present actions, never achieving the distance necessary to create a past or a future. In Fernand Dumont: A Sociologist Turns to Theology, Gregory (...) Baum interprets Dumont's L'institution de la théologie, which studies the assumptions and commitments implicit in the rational reflection of Catholic thinkers on the meaning of their faith. Baum shows that while Dumont's book is preoccupied with the theoretical, its methodology is informed by the cognitive presuppositions of the social sciences, and its contents - dealing with the spiritual, personal, and social struggles that constitute daily life - are concrete. For Dumont religious truth is insufficient, and may have no impact on everyday life. What counts is relevance, insights that reply to urgent questions and unresolved conflicts. He offers an innovative interpretation of Catholicism that is faithful to the Gospel and relevant to the problems of modern life and the serious questions Quebecers are asking themselves. The contributors in _Expanding and Restricting the Erotic_ offer a multidisciplinary perspective on the ways in which what is considered acceptable within the realm of the erotic has altered over time to the current situation where the erotic is being both expanded and restricted.

Those who think of some aspects of the world as "physically necessary" usually think of this kind of necessity as being confined to the general law of nature, initial conditions being "contingent." Tachyon theory and general relativity provide independent but related reasons for thinking that some initial states are, however, "impossible." And statistical mechanics seems to lead us to conclude that some initial conditions are, if not impossible, "highly improbable." We are then, led from these aspects of physics to wonder (...) if initial conditions are always "freely specifiable" and in the domain of physical contingency. (shrink)

Just as the existence of practical akrasia has been treated as important evidence for the existence of our practical agency, the alleged absence of epistemic akrasia—cases in which a believer believes some proposition contrary to her considered judgments about what she has most reason to believe—has recently been marshaled as grounds for skepticism about the existence of similar forms of epistemic agency. In this paper, I defend the existence of epistemic agency against such objections. Rather than argue against the impossibility (...) of epistemic akrasia, I argue that the impossibility of epistemic akrasia is actuallycompatible withthe existence of epistemic agency. The crucial mistake, I argue, is that skeptics about epistemic agency are failing to distinguish carefully between differences in the structure of believing and acting and differences in the structure of normative reasons to believe and normative reasons to act. I show that once these ‘environmental’ differences are properly distinguished, we can see that absence of epistemic akrasia provides no reason to doubt that practical and epistemic agency are on a par with one another.
